            It appears an article in our last issue, has restored reason to an overtaxed and delicious administration, and the result is a retreat.

 

The Queen and Her Cabinet

            The framers of the American constitution with the example of Lord North before them, wisely determined that there should be no constitutional status for a cabinet tyrant, and with this modification, the United States constitution, stands in all essential today, in the distinctive powers of President, Senate and House of Representatives; what the unwritten constitution on England was in King, Lords and Commons, one hundred and twenty years ago. Certain it is that among the amendments passed, the original preroggratives of the President remain, and every candid writer will admit that all the rights of the President of the United States to-day, were copied from the rights of monarchy as exercised in England when the U. S. constitution was framed, and among the President's rights will be found that said to be now claimed by Queen Liliuokalani.

            A fact not generally recognized by non-Englishmen, who write on English politics is, that the liberal concessions gained by the people since the days of King John, had to be wrested by force from the Lords, but were generally aided by the King, and if a vote of the common people of England was taken t0-day to test the question of which should be abolished, monarchy or the House of Lords; the latter would received an almost unanimous vote. Among the dangers to the stability of monarchy all the world over is its own tendency to capriciousness in appointing favorites of the Court, rather than of the people.

            Queen Victoria in her early days was waited upon and surrounded by a coterie of feminine politicians, (as at present here) who took advantage of her youth and inexperience to thwart even a vote of the House of Commons.  The moderation of the assembled wisdom of the nation prevented the consequences to the young Queen, but it raised a discussion in both Houses, which contributed in no small degree to the final retirement of Lord Melbourne from public life.

            The feminine head that wears a crown is always more in danger from being surrounded by an excess of petticoats than prerogatives.

The Barry Contempt Bill.

 

            The adverse report of the Senate Judiciary Committee on the Barry Contempt of Court bill, prepared after the address of Judge Shafter Friday evening last, was held back until yesterday morning, when the committee reversed its actions, and reported the bill with an amendment for passage. In the course of the controversy over the matter the committee heard Mr. Barry, Thomas V. Carter and others in behalf of the bill and G. A. Blanchard, Grove L. Johnson and ex-Judge Armstrong against it. The points raised by the latter were that if courts and juries were turned over to the tender mercies of the sensational press their would be an end of justice for it would b no offense to purchase newspapers to browbeat judges and influence juries and wealthy men with great interests at stake would not hesitate to do so. The committee as it finally amended the bill practically murdered it, for the purpose was to provide that no Court shall take notice of contempts committed outside of its immediate presence. This was defeated by the insertion of the word "or" in the last paragraph of the bill. As reported this paragraph now reads as follows:

            "But no speech statement or publication reflecting upon or concerning any court or any officer thereof shall be treated or punished as contempt of such court, unless made in the immediate presence of such court while in session or in such a manner as to actuaily interfere with its proceedings."
